Prohibited Acts

  • No smoking, no vaping.
  • No launching of motorized watercraft.
  • Climbing or defacing: No person or persons shall climb, cut, break, damage, deface, injure, remove or disturb any tree, bush, shrub, building, fence, bench or structure or remove any shrub, bush or flower, or mark or write upon any building, fence, bench, or other beach structure.
  • Animals: It shall be unlawful for any owner to permit his or her animal on the dedicated beachfronts or other public beachfronts, whether or not dedicated, or public walks.
  • Illegal Drugs: No person or persons shall bring, consume, possess or be under the influence of any illegal or dangerous drugs on the public walks or dedicated beacyhfronts or other public beachfronts, whether or not dedicated.
  • Refuse: Dumping of refuse or littering is prohibited on the dedicated beachfronts or other public beachfronts, whether or not dedicated, and all such refuse shall be placed on containers provided.
  • Solicitation: No person or persons shall solicit any businesses on the public walks or dedicated beachfronts or other public beachfronts, whether or not dedicated.
  • Vehicles: All unauthorized vehicles are prohibited from all beach areas.
  • Boating and fishing of any kind: No person or persons shall boat or fish in the bathing areas.
  • Intoxicating liquors: No person or persons shall bring or consume any intoxicating liquors on the public walks or dedicated beachfronts or other public beachfronts, whether or not dedicated.
  • Bicycles: No person shall ride a bicycle on any public walk at the beaches.

Regulated Activities

  • Fires: No fires, grills, or cooking equipment will be permitted on the dedicated beachfronts or other public beachfronts, whether or not dedicated, without a permit, in writing, from the Department of Public Works, Parks, and Engineering.
  • Holes: No hole shall be dug in the dedicated beachfronts or other public beachfronts, whether or not dedicated, in such manner as to leave a depression more than 12 inches deep in the surface of said land.
  • Tampering with lifeguard equipment: No person or persons shall use or tamper with any boat or lifeguard equipment, including swimming area, lines and buoys, except in case or emergency, without the permission of the beach manager.
  • Public assemblage: No person or persons shall hold, conduct, or address any public assemblage without first obtaining a written permit from the Department of Recreation.
  • Distribution any posting of matter: No person or persons shall distribute any circulars, cards, or written matter or post, paste, or affix any placard, notice, or sign on the beach without first obtaining written permission from the Department of Recreation.
  • Motorized vehicles: Motorized vehicles are restricted to parking lots and roadways.
  • Vending: No person or persons shall peddle, vend, sell, or offer for sale any goods or merchandise on the dedicated beachfronts for other public beachfronts, whether or not dedicated, or public walks, and parking areas without permit, in writing, from the Department of Recreation.

Dune & Beach Preservation

  • No person shall remove, destroy, or tamper with the natural vegetation, sand fences, or other type of dune or beach protective measures or devices.
  • Designated accessways for pedestrians only. No motor vehicles permitted or motor vehicle access provided, except for emergency vehicles or maintenance of the dunes and beaches by authorized personnel.
  • Limited authorized accessways: Consisting of stairs, ramps, pathways, walkways, and boardwalks for pedestrians between public streets or parking areas shall be provided in a manner ensuring the minimal feasible interference with the dune and beach system.
  • Accessing the dunes or beach areas outside of the designated authorized pedestrian accessways as defined above shall be prohibited.

Violations

Any person adjudicated as having violated an act which is prohibited or which is declared to be unlawful or an offense or for the nonperformance of an act which is required to be done, the violation of any such provision shall be punished by a fine not exceeding $2,000 or by imprisonment for a term not exceeding 90 days, or by a period of community service not to exceed 90 days, or any combination thereof.
