In accordance with N.J.S.A. 40A:10A-1 et seq. and Middletown Township Ordinance 2023-3369 (PDF), the owner of a business or a rental unit(s) located within the Township of Middletown is required to maintain liability insurance for negligent acts and omissions. Specific requirements are indicated below. Property owners should consult with an insurance professional, as required, to satisfy these new registration requirements. Property owners who fail to comply with these requirements may be subject to a fine of $500 for each property owned.
By January 1st of each calendar year, the owner of a multi-family home which is four or fewer units (one of which is owner-occupied) shall provide a Certificate of Insurance (COI) to the Township that maintains liability insurance in an amount of no less than $300,000 for combined property damage and bodily injury to or death of one or more persons in any one accident or occurrence.
Otherwise, the owner of a business or rental unit(s) shall annually, by January 1st of each calendar year, provide a COI to the Township that maintains liability insurance in an amount of no less than $500,000 for combined property damage and bodily injury to or death of one or more persons in any one accident or occurrence.
Additionally, a valid COI must be submitted at the time of submitting a landlord registration or seeking a rental inspection for a change of tenancy.
